Terms & Conditions

  1. The protection plan is between you (the customer) and B.A. Colella Heating & Cooling, LLC. This plan is available for residential customers only. All equipment must meet state and local installation codes. B.A. Colella Heating & Cooling, LLC offers several different plans. What is covered is listed below.

  2. Conditions & Exclusions: B.A. Colella Heating & Cooling, LLC reserves the right to cancel any plan with 10 day notice to the customer. For reasoning if customer fails to pay the agreed amount (price) of plan or has misrepresented him or her self-relating to the equipment or its use. Any repairs on service provided after cancellation of the plan will be billed at the same price that a customer would pay who does not have a service plan.

  3. Conditions beyond our control: B.A. Colella Heating & Cooling, LLC will not be responsible for any delays caused by parts, vendors, or suppliers due to strikes, closing or any accidents, storms, vandalism and any other acts of God. B.A. Colella Heating & Cooling, LLC will not be responsible for misuse or abuse of equipment. B.A. Colella Heating & Cooling, LLC will not bear the cost of repairs for equipment that is beyond our control. The customer will be responsible for costs of special shipping charges, freight cost for overnight delivery of parts if so desired. B.A. Colella Heating & Cooling, LLC will do its utmost to expedite in obtaining original parts for customers’ equipment or approved substitution parts.

  4. What is covered: The total cost of parts and labor necessary to perform the selected equipment tune-up during normal business hours Monday–Friday 8:00am to 4:30pm. Customers enrolled in service plan have priority service scheduling over non-enrolled customers.

  5. What is not covered: Electrical problems outside the equipment (heating) or (cooling) units; turned off switches or disconnects; flooding of equipment due to water from outside sources, purposely or accidental, damage of equipment (heating or cooling units), fire or smoke damage due to outside sources, glycol or anti-freeze for hydronic systems, defective parts, refrigerant/water leaks, coil cleanings, or equipment replacements.

  6. B.A. Colella Heating & Cooling, LLC will perform 1 minor balancing per year during tune-up visit.

  7. Charges: B.A. Colella Heating & Cooling, LLC will provide a 10% discount to contract customers on repairs and 5% discount on replacement Heating and Cooling systems. Customer must be enrolled in the plan for one year before being eligible for the above discounts.

  8. Any alteration or deviation from the above specifications will be executed only upon written order, and will become an extra charge over and above the estimate.

  9. This proposal may be withdrawn by the Contractor if not accepted with 30 days of the date hereof.

  10. This Agreement contains the entire agreement of the parties. This Agreement replaces and cancels any previous Agreements between the Contractor and the Purchaser. In addition, any modifications and/or waivers of this Agreement and its amendments by the Contractor and/or Purchaser must be in writing to be enforceable.
